Purchase conditions

This agreement governs the general purchase conditions of the diverse products offered within this website by THE BLUE DOLPHIN STORE, S.L. (henceforth THE BLUE DOLPHIN) with NIF nº B67537886 and address in 403 Balmes Street, ESC B. 4º 1ª, 08022, Barcelona (Spain).

The CLIENT the moment the registration process is completed, and purchases any of our products, accepts and submits himself/herself to the clauses specified hereunder, as well as the terms of access and use of our portal and its privacy policy, accessibles through the link “Privacy” and “Legal”.

The CLIENT acknowledges that it has adequate legal capacity to enter into this agreement.

1.PRICES AND TAXES

As consideration for the acquired product, the CLIENT expressly agrees to pay to THE BLUE DOLPHIN the corresponding fees as specified at the time of purchase in the pricing relation established on the website www.thebluedolphinstore.com for the chosen products.

The products offered in the website are subject to the Value Added Tax (VAT) which IS INCLUDED in the prices that are given for each product.

Transportation costs are NOT included in the price of the products. Customs charges are not included in the case of purchases outside the EU.

Once the products have been chosen, before the order confirmation and after proceeding with the payment, in the screen will appear the final purchase price including VAT (Value Added Tax), handling, packing and shipping costs, if applicable, which will be reflected in the order form at the time of purchase and in the invoice.

Everything that is not specified in the description as included, it is not included.

2. PURCHASE PROCEDURE

Through this website, purchase orders must only be made by individuals over 18 years old and companies.

 The website displays all our products one by one. The procedure to carry out and manage the purchase is indicated on the website and you only have to carry out the following steps: 

  1. Choose the product you want to acquire.
  2. When selecting the product, this can be added to the shopping cart and you might choose between continuing purchasing or processing your order. 
  3. To process your order, you must click on the “Proceed to checkout” button and choose if you want to access as a registered user (if you are already a CLIENT) or register as a new user. Then you should fill out the form with your personal information in order to formalize the purchase procedure.
  4. Next, the verification of the order will follow, where the products selected are detailed one by one and the final price is calculated.
  5. Likewise, it is necessary to indicate the billing address and delivery address. It is possible to write a single address for billing and delivery.
  6. Once the process is finished, it is necessary to check the box verifying the prior reading and acceptance of the terms conditions of sale. 
  7. On the website will be provided the mechanisms for carrying out payment depending on the method chosen.
  8. Once the payment details are introduced, you must confirm the payment by clicking the “Place order” button.
  9. After clicking the “Place order” button, the delivery procedure will start. 

The CLIENT acknowledges that the product images and descriptions displayed on the website are an approximately image of the products offered so they might differ from the original one. The descriptions and images of the products available on this website are given only for information.

3. AVAILABILITY AND DELIVERY

The products offered by THE BLUE DOLPHIN are available to distribute anywhere in the world.

The orders will be processed once the payment has been received correctly.

The products offered by THE BLUE DOLPHIN will be always subject to the availability which will be specifically indicated in our website for each product so in case any of the products is not available the CLIENT will be properly informed. Under normal conditions, all products appearing on our website are available for delivery within the time limits indicated.

In the case where, once the order is made, the product purchased by the CLIENT is out of stock, it will be properly informed and it will be offered an alternative product with similar price and quality characteristics to the purchased product. If the CLIENT still does not accept the proposed alternative, THE BLUE DOLPHIN will proceed to refund the amount paid and inform about the repayment procedure and terms.

As a general rule, the maximum delivery time is between 2 and 7 days from the time of purchase and from the time the payment is confirmed, all of that, for mainland Spain. These delivery deadlines are approximated and in any case binding for THE BLUE DOLPHIN.

Delivery will take place on business days (monday to friday). It is advisable that the CLIENT communicates its preferences regarding delivery time slots when filling up the order information in the Order Notes section.

The delivery of the purchased product will be carried out by the carrier in the address indicated in the order form and the CLIENT will sign the reception. Likewise, the CLIENT will be properly informed in case there is an incidence or if the delivery is delayed for any reason.

If delivery in the indicated address is not possible due to the absence if the receiver, the carries will directly contact the CLIENT and will indicate in detail the the steps to follow. In the case the impossibility to deliver is caused by entering a wrong address, the order reshipment cost will be paid by the CLIENT. THE BLUE DOLPHIN is not responsible for the delays in the delivers of the purchased products due to causes attributable to the carrier.

In order that you are informed at all times of the status of your purchase, you will receive via email a notification of your order confirmation and payment.

Likewise, the CLIENT can check the status of its order by sending an email to the address delivery@thebluedolphinstore.com.

4. PAYMENT

The following forms of payment are accepted:

  • Credit card: the transaction is performed by connecting directly with the banking institution BANCO DE SANTANDER through its payment gateway.
  • STRIPE: through the different payment method offered by the platform.

Once the payment has been executed, you will receive a payment confirmation email.

The cardholder is responsible for the transaction.

THE BLUE DOLPHIN does not have knowledge regarding your credit card information. All our payment systems are completely secure.

THE BLUE DOLPHIN uses an SSL certificate to ensure the CLIENT the authenticity of the server and the encryption  of their data, being a test of integrity in communication. With this valid SSL certificate, communications over the Internet are transmitted in encrypted form. You can trust that the information you send will be received privately and without alteration to the server with which the connection is established. With said system:

  • The privacy of the information provided by the CLIENT within the website is guaranteed, protecting the process of data transmission between the CLIENT and the server.
  • Secure online transactions are offered.
  • Confidential information is protected during the data transmission process between the CLIENT and the server, making its interception or theft impossible.
  • The identity of the company responsible for the website and the name of the issuing identity are shown, as well as geographic location and certificate validity data, among others.

The payment is prior to the product delivery so THE BLUE DOLPHIN won’t deliver the requested product until the moment the payment is received.

THE BLUE DOLPHIN reserves the right to extend or modify the current methods of payment and/or to cancel temporarily or permanently its services in the event of an incidence regarding the cashing of these.

5. INVOICES

When making the corresponding payment and after the order is completed, you will receive the invoice of your order in PDF format in the email you provided during the checkout process. 

The CLIENT is responsible for the confirmation of the reception of notifications and for informing us about any modification of the data, leaving THE BLUE DOLPHIN exempt from any responsibility derived from these circumstances.

6. WARRANTY

In THE BLUE DOLPHIN we strive for providing the maximum quality service, although, given the nature of the products, we cannot offer a satisfaction warranty. In the case that, for any reason, you do not receive the product correctly, you should communicate it to us as soon as you can, indicating the incidence which we will try to rectify as early as possible, if the error is verified.

The details of the products are indicated in their description. THE BLUE DOLPHIN is not responsible for the possible effects caused by allergic reactions to the products components.

7. RETURNS

Returns or change of products are only allowed in case of manufacturing defect, transportation damages or delivery mistakes. In any case, no more than 14 days shall pass since the product reception and the product must not be opened. It will be verified, prior to the acceptance of the return, that it is a manufacturing or packaging defect or anomaly and not an inadequate or negligent use, manipulation or storage. At the time of returning the order it must always include the packaging and the invoice.

With returns due to a manufacturing or packaging defect as well as returns due to a mistake with the order the CLIENT will be offered, if possible, the replacement of the product or a substitution for another alternative without additional costs and without the right, on the part of the CLIENT, to any kind of compensation. The costs of delivering the right order will be paid by THE BLUE DOLPHIN. 

In any case, the returns will always be subjected to the previous examination by THE BLUE DOLPHIN of the returned product status and the verification that it meets the requirements demanded in these purchase conditions. Once the return has been received and verified, we will refund the cost within a maximum period of 30 days and in the same terms used to make the purchase.

THE BLUE DOLPHIN reserves the right to reject returns communicated or sent beyond the stipulated timeline or returns of products that are not in the same conditions in which they were received.

The returns are managed through sending an email to hello@thebluedolphinstore.com describing the reasons and causes of the return and a photograph of the damages or defects. Likewise, it is necessary to indicate the name and surnames and the order reference number. Once the petition has been received, we will process it appropriately. 

8. RIGHT OF WITHDRAWAL

Independently from the return of products for the indicated reasons, you have the right to withdraw the purchase within a period of 14 calendar days without any justification. 

The period to exercise this right will expire after 14 calendar days from the day you acquire the material possession of the product. 

To exercise the right of withdrawal you have to notify THE BLUE DOLPHIN STORE, S.L. C/Balmes, 403 ESC B. 4º 1ª, 08022, Barcelona, email: hello@thebluedolphinstore.com, your decision of withdrawing from the purchase through a clear statement (for example, by a letter sent through postal mail or email).

To comply with the withdrawal period, you just have to send the communication before the deadline is reached.

Consequences of withdrawal:

In case of withdrawal, we will refund the payment, including the shipping costs (except the addition costs resulting from your election of a different delivery method from the less costly ordinary delivery method we offer) without undue delay and, in any case, later than 14 calendar days from the date you inform us about your decision of withdrawing from the purchase.

We will proceed to refund using the same payment method you chose in the first purchase; in any case, you won’t incur any cost as a consequence of the refund.

In any case, we can retain the refund until we receive the products.

Once the withdrawal request is notified, you must return the products a THE BLUE DOLPHIN STORE, S.L. C/Balmes 403, ESC B. 4º 1ª, 08022, Barcelona (Spain), without undue delay and, in any case, later than the 14 calendar days period from the date you communicated your decision of withdrawing from the purchase. The period will be complied if the products are returned before the deadline. 

The returned products must be in perfect state, without being opened, damaged, not presenting deformations nor signs of wear, scratches or stains. You will be responsible for the decrease in the value of products resulting from a different manipulation from the necessary given the nature and characteristics of the products. 

9. PURCHASE CONCLUSION AND SERVICES MODIFICATIONS

The purchase will be concluded with the payment of the product and with the email sent to the CLIENT of the confirmation with a description of the purchase made. 

THE BLUE DOLPHIN reserves the right to modify, in any way and any time, the services characteristics and conditions, always with the goal to improve them and that they represent a benefit for the CLIENT.

10. PARTIES OBLIGATIONS 

THE BLUE DOLPHIN undertakes to provide the CLIENT the acquired products implementing the maximum diligence in the provision of services, as well as taking care of the necessary maintenance of the installations for the functioning of the network, via an adequate technical and informatic team, as well as managing the logistics, shipping and delivery operations through a carrier.

THE CLIENT undertakes to use the services available to them in good faith, without violating the existing laws in whichever matter or infringe the rights of third parties, as well as to pay the chosen product in the time and method established in the these conditions of purchase and to its reception in the indicated delivery address.

THE BLUE DOLPHIN does not guarantees that the availability of the service subject to this contract will be continuous and uninterrupted, being able to be suspended temporarily due to circumstances originated by problems with the Internet network, breakdown of informatic devices and other unpredictable circumstances. Therefore the CLIENT accepts to bear within reasonable limits this circumstances and expressly renounces to claim to THE BLUE DOLPHIN any contractual or extra-contractual responsibility for the failures, mistakes or use of the contracted service. 

11. COMMUNICATIONS

All the notifications between the parties will be realized preferably through email. The CLIENT is responsible for the confirmation of the reception of the notifications and of informing THE BLUE DOLPHIN about any modification of its data, leaving the company exempt from any responsibility derived from this circumstance. In the case of modification of a relevant data, the client will inform THE BLUE DOLPHIN in the email indicated in our website.

In compliance with the article 21 of the Law 34/2002 on Information Society Services and Electronic Commerce, we inform that our commercial mails and information related to our website and the products offered, will be sent by email to the email address you provided, always subject to withdrawal. In any case, you have the option to reject our commercial communications by sending an email to hello@thebluedolphinstore.com indicating in the subject the word UNSUBSCRIBE.

12. COMMITMENT, ACCEPTANCE AND VALIDITY OF THE PURCHASE

The CLIENT acknowledges to read and accept the purchase conditions, the legal conditions of use and the privacy policy of this website.

The CLIENT acknowledges to understand all the information related to the products, including the delivery, offered on the website, as well as all the conditions and stipulations gathered in the present electronic purchase contract, so it declares they are sufficient to exclude any error in the acceptance of this contract and therefore expressly accepts them in their entirely.   

The CLIENT is completely aware that the acceptance and execution of this electronic purchase contract will take place via the provision of its data and the by pressing the “Proceed to checkout” button displayed in our website and that it will be concluded with the payment of the products.

13. APPLICABLE REGULATION

This contract of electronic purchase has commercial nature and it is governed and interpreted according to the Spanish law.

In the case any discrepancy or difference between the parties occur in relation with the interpretation, content or execution of the contract that is not solved by mutual agreement, the parties shall be submitted to the Courts of Barcelona to expressly forego any other forum which may correspond to them.
